During this meeting, we will discuss in detail the obligations of the contractor to properly perform and deliver the work. The procedural aspects of completion will also be discussed. Furthermore, we discuss the maintenance period and the consequences of the expiration of this period with specific attention to the so-called 5% rule in contracts with consumers. We teach you to distinguish between the different types of complaints: completion and maintenance defects, hidden defects, serious defects, delivery defects and warranty defects. In doing so, we also pay attention to the complicated doctrine of the many different limitation and expiration periods in construction and the duty to complain. Finally, we address the remediation of complaints by the contractor. What can then be expected of a contractor and what are the legal consequences of redress? We illustrate all this with many practical examples.
