Since May 25, 2018, with the introduction of the AVG, the privacy rights of data subjects have been strengthened and anyone - who believes that his or her personal data is being processed unlawfully - can file a privacy complaint with the Personal Data Authority. Over 600 data subjects have now taken advantage of this opportunity.
What is striking here is that many problems are encountered when it comes to removing personal data. Those concerned want to have their data removed from an organization or online, for example because they no longer wish to receive newsletters or advertisements, and are unable to get this done or run into a brick wall with the organization concerned. Almost a third of the complaints are about this. In addition, data subjects mainly complain about not being allowed to view their personal data and about the unwanted disclosure of their data to third parties. Most of the complaints are about companies, over 85 percent(!), and the rest concern government agencies. The Personal Data Authority has processed all complaints.
